But it is the question being asked in **eight states at once**: independent voters are suing to open closed primaries in Maryland, Pennsylvania, Oregon, and Wyoming, while the parties sue to shut open ones in Texas and South Carolina. Ballot measures are moving in Massachusetts, Florida, and Colorado — and in California, party insiders are trying to repeal the state’s own **nonpartisan** primary and replace it with the old closed primary system. Ultimately, the Supreme Court will have to settle the question: If primary elections are an important part of our public election process, can any state exclude voters from participation because they exercise their first amendment right NOT to join a political party? Coincidentally, or not, a former Republican is now the great hope of Maine's Democratic Party.
