Court’s Decision on “Fetal Pain” Bill Could Affect Other States

Last week, the Superior Court of Fulton County temporarily suspended an abortion ban in Georgia that would have made pre-viability abortions illegal. The law would have criminalized most abortions starting at twenty weeks of pregnancy.
The American Civil Liberties Union (ACLU) and the ACLU of Georgia challenged the ban on behalf of three obstetrician-gynecologists who have patients in need of such medical care. According to the ACLU, the Georgia abortion ban offered very few and narrow exceptions for the life and health of the mother.
“This law places women in harm’s way by depriving them of the right to make their own serious medical decisions,” Alexa Kolbi-Molinas, staff attorney with the ACLU’s Reproductive Freedom Project. “Politicians should not place ideology over a woman’s health.”
Very few abortions occur past five months, but the ACLU argued that there are a variety of reasons a woman would end a pregnancy past that point, including a threat to the woman’s health, the fetus has been diagnosed with a serious medical condition, the pregnancy has failed, or it is determined that a miscarriage is inevitable.
The Georgia abortion ban was set to take effect on January 1. The suspension of the ban could open the door for legal challenges against other states that have passed or are considering similar legislation, including Texas.
When the 83rd Texas Legislature convenes in January, access to abortion will be among the many issues that will be addressed by state lawmakers.
Specifically, some legislators will seek to implement further limitations on patients and doctors, including putting restrictions on rural access, preventing health care providers affiliated with abortion clinics from participating in the state’s Medicaid program, and a ban on abortion after twenty weeks.
The twenty week abortion bans have been called “fetal pain” bills by advocates. The name comes from the conclusion of some researchers that fetuses begin to feel pain around the twentieth week of development. Though medical experts and scientists dispute this claim, it is certainly a name that can have an emotional impact.
Earlier this month, Texas Governor Rick Perry said he is prepared to support a “fetal pain” bill that passes through the Legislature. During a speech at the Source for Women, a pregnancy crisis center in Houston, he said his goal “is to make abortion at any stage a thing of the past.”
Anti-abortion advocates saw a number of victories during the 82nd Texas Legislature in 2011, including the passage of a law that requires physicians to perform a sonogram 24 hours before a woman undergoes the controversial procedure.
While Republicans no longer have a supermajority in the Legislature, they still have a solid enough majority to pass additional abortion restrictions. If a “fetal pain” bill is passed, Texas will be the tenth state to implement such a law.

The philosophical question is when does life begin. Some lawmakers say 2 weeks before conception when you ovulate. Others say when the egg divides the first time. Then there are those who say when the fetus has a heartbeat or brain waves. Finally some argue that the fetus is not able to survive outside the womb on it’s own until around 9 months. This is a question that can be answered many ways. I, personally, would like to see the criteria they use to “unplug” a person who has not hope used on fetuses. To me, it isn’t murder when its a wad of cellls, but an abortion at 7 months is horrifying.

So many better ways to reduce abortions than these horrendous assaults on womens privacy. Providing cheap and easy access to birth control decreases the number of abortions AND the number of unwanted children by well over 70%. Get that? A 70% reduction in abortions AND unwanted children. Just because you’ve succeeded in preventing an unwanted child from being aborted doesn’t really mean you’ve actually SAVED anybody.

I believe that women should have the right to choose for themselves. Simple as that. I don’t believe in any law that restricts other’s freedoms regardless of my morals or anyone else’s. Plus we already have enough laws that retrict our freedoms as it is.

What Rose says is so true. The way to cut down on abortions is to have free or cheap, easily accessable birth control. However, sometimes unplanned pregnancies happen. Birth control can fail. In these instances, it is a discussion between a woman and her doctor and no one else.

“Biologist Scott Gilbert, an expert in human development, tells us that there are at least four distinct moments that can be thought of as the beginning of human life. Each can be said to be biologically accurate.
The genetic view (the position held by the Roman Catholic Church and many religious conservatives) holds that life begins with the acquisition of a novel genome; it is a kind of genetic determinism.
Those who hold the embryologic view think life begins when the embryo undergoes gastrulation, and twinning is no longer possible; this occurs about 14 days into development. (Some mainline Protestant religions espouse a similar view.)
Proponents of the neurological view adhere to brainwave criteria; life begins when a distinct EEG pattern can be detected, about 24 to 27 weeks. (Some Protestant churches affirm this.) Interestingly, life is also thought to end when the EEG pattern is no longer present.
Finally, one can say that life begins at or near birth, measured by fetal viability outside the mother’s body. (Judaism affirms something close to this position.) After all, somewhere between 50 and 60 percent of all embryos conceived miscarry.
So, when does life begin? I do not think we can know this with any more certainty than we know when life ends. People of faith, and people of good conscience, are going to have to agree to disagree—with a good dose of humility—on matters of life and death.”

Murder is the unlawful killing of another human being. In that we have such a diverse opinion as to what constitutes a ‘human being’…I doubt seriously that we all would be able to come to the same conclusion that abortion is murder. I know that I do not agree that ‘personhood’ starts at conception..it gives me images of police and CPS workers storming hospitals where women have miscarried and having the poor women undergo intensive interrogations to ensure that the women didn’t do anything ‘harmful’ to create the miscarriage. In my own field, I have met a lot of women who have chosen abortions…never once was it a matter of convenience..it was always a super heavy decision never taken lightly and also having considered a variety of options, never done without some guilt…it is not my place to judge these women for their choices and it CERTAINLY not the government’s place to intervene.

If you won’t believe the sonagrams if they still have it I dare you to go and stand in front of the fetal developement wall at the Chicago Museum of Science and Industry. Every one of those is a real fetus preserved in formaldahyde. A lot of arms and legs there and abortion is legal in this country right up until the baby pops out on its own and except in real rare case all those had arms and legs. Science says life begins when the 46 chromosomes unite and begin developement on their own. Science has always said that even before the pill was developed.

Drug companies changed the definition of life so they could sell you a dangerous drug. I took biology both before and after the developement of the pill both say life begins when the embryo begins to divide and develope on its own. BTW there is a perfectly safe version of the hormonal contraceptive and they developed the male contraceptive at the same time. They don’t put out the first because you can’t get a patent on the pure hormone and make a fortune. Why they don’t put out the second ask all the male scientists and drug company owners maybe they know something you don’t?

I’ve always been pretty leary of celebate (unless you count altar boys) unmarried men dictating birth conrol options for women. Talk about pushing YOUR religon onto others. Looks like maybe a little house cleaning is in order before the Popes keep telling us all about how sinful abortion and birth control are. Of course estrogen and progesterone are naturally occurring except that is not the form you get them in. If you did it would be safe. Have you really read the package insert. Every one of those side-effects are not only possible they really happen. Want to see my scars? Want to live with my permanently reduced leg circulation and possible coronary problems? I know all of this from personal medical experience. I exchanged a OB/GYN for a vascular surgeon. It is the other things they are mixed with so that they can be patented. Pure hormones cannot be patented the body produces them check it out. I have a question In the process of discovering the hormonal contraceptive they discovered the male contraceptive too. Why aren’t all the guys who don’t want to be fathers taking them. BECAUSE THEY WERE NEVER MARKETED. Guys aren’t stupid enough to put their body on the line they con you into it.

Let’s see are you smart enough. Do you take your pill every day at the same time everyday without fail? Because that is how it has to be done to be 90% effective. That still means it fails 1 in 10 times on average. If you don’t follow those rules the effectiveness drops off radically. I know these things because I have been down that path girl. You are a neophyte and since you will not listen to anyone we cannot save you the pain and suffering we have gone through. But I beg you read the package insert and believe every freaking word in it.
